HC refuges writ against govt-formed poll committee for FFs

DHAKA: The High Court Thursday rejected the writ petition filed against the committee formed by the government to hold election to the Muktijoddha central command council.

Justice Moinul Islam and Justice AKM Abdul Halim issued the order.

Earlier, the government formed a five-member committee on December 29, 2009 through a notification for holding the election.

Malek Hossain Pir, a candidate for the post of organizing secretary, filed a writ petition challenging the legality of the committee on June 23.

The writ petition said the Muktijoddha central command council should form the election commission according to law. “But, violating the law, the government formed the commission.”

The High Court summarily rejected the petition. The court, in the verdict, said the petitioner himself is a candidate for the post of organizing secretary. “He has done self-contradictory act by filing the petition,” the court added.

The court also noted that it was not recorded that the writ petitioner was loser anyway. Besides, there is a case pending with the Appellate Division. “So, the High Court should not interfere with the matter.”

Advocate Mansur Habib conducted the hearing on behalf of the petitioner and Attorney-general Mahabube Alam and additional Attorney-general Murad Reza were for the government.
