A Dhaka court today (January 29) sentenced Evaly Managing Director Mohammad Rassel and his wife, Chairperson Shamima Nasrin, to two years of imprisonment in a fraud case.

Metropolitan Magistrate Partha Bhadra delivered the verdict on Wednesday. 

In addition to the jail term, both were fined Tk 10,000 each, if failed to pay will serve another two months of imprisonment.

The accused were absent during the verdict, and the court issued an arrest warrant against them along with the sentencing order.

According to the case statement, Evaly attracted customers through its website and Facebook page with flashy advertisements. Plaintiff Toufiq Mahmud ordered a Yamaha R15 bike from Evaly on March 20, 2021, paying Tk 2.45 lakh. On April 3 of the same year, he ordered two more bikes, paying an additional Tk 5.90 lakh. However, Evaly failed to deliver the bikes within the promised 45 days.

When Mahmud contacted Evaly’s Dhanmondi office, the company issued him two cheques but requested him not to deposit them due to insufficient funds. Trusting them, he did not deposit the cheques. Later, he repeatedly demanded the return of Tk 14.10 lakh, but the company did not refund the amount. Even after sending a legal notice, he received no response.

As a result, Mahmud filed a case against Rassel and Shamima on February 4, 2024, leading to the court’s verdict.
